These Terms & Conditions apply to the use of gmmortuary.co.uk and to the sale, supply, delivery, installation, servicing, and maintenance of products and services provided by GM Mortuary, a trading name of Gmcold Refrigeration Ltd.
By using this website, requesting a quotation, placing an order, or purchasing from us, you agree to be bound by these Terms & Conditions. Please read them carefully before placing an order.
1. About GM Mortuary
GM Mortuary is a UK supplier of mortuary equipment, mortuary refrigeration systems, mortuary chambers, mortuary cold rooms, autopsy tables, post mortem equipment, funeral director equipment, and related installation and servicing solutions.
2. Business Customers and Consumers
Our products and services are primarily supplied to business, commercial, healthcare, funeral, local authority, and professional customers. These may include funeral directors, hospitals, mortuaries, healthcare facilities, public sector organisations, and post mortem facilities.
Where you purchase from us as a consumer, your statutory rights are not affected. Nothing in these Terms & Conditions is intended to exclude or limit any rights that cannot legally be excluded.
3. Website Information
We make reasonable efforts to ensure that product descriptions, specifications, images, prices, availability, and other website information are accurate and up to date. However, product images are for illustration purposes only and actual products may vary depending on manufacturer specifications, design updates, finishes, accessories, installation requirements, or availability.
4. Quotations and Orders
Quotations are provided based on the information available at the time of issue. Unless stated otherwise, quotations may be subject to product availability, manufacturer pricing, delivery charges, installation requirements, site access, VAT, and any additional works required.
An order is accepted only when we confirm acceptance in writing, issue an order confirmation, or begin processing the order. We reserve the right to decline or cancel an order where products are unavailable, pricing errors occur, payment is not received, or the order cannot reasonably be fulfilled.
5. Prices and VAT
Prices may be shown excluding or including VAT depending on the product, customer type, or page layout. Where VAT applies, it will be charged at the applicable UK rate. Delivery, installation, commissioning, servicing, and additional works may be charged separately unless clearly included in writing.
6. Payment Terms
Payment terms will be confirmed at the time of quotation or order. For certain products, including bespoke mortuary equipment, mortuary chambers, mortuary cold rooms, refrigeration systems, or special-order items, a deposit or full payment may be required before manufacturing, ordering, dispatch, delivery, or installation.
Goods remain the property of GM Mortuary / Gmcold Refrigeration Ltd until payment has been received in full, unless otherwise agreed in writing.
7. Delivery
We provide UK mainland delivery for a wide range of mortuary equipment, mortuary refrigeration systems, mortuary chambers, mortuary cold rooms, autopsy tables, and post mortem equipment. Delivery charges, estimated delivery times, and delivery arrangements will be confirmed before dispatch where applicable.
Delivery times are estimates only and may vary depending on stock availability, manufacturer lead times, production schedules, existing manufacturer orders, courier availability, site access, product size, and installation requirements. Please contact our sales team before ordering for the most accurate delivery estimate.
8. Site Access and Installation
Where delivery, positioning, installation, or commissioning is required, the customer is responsible for ensuring suitable site access, clear working areas, adequate floor loading, appropriate electrical supplies, drainage where required, and any permissions needed for safe installation.
Additional charges may apply where access restrictions, failed delivery attempts, delays, unsafe working conditions, incorrect site information, or additional works affect the agreed delivery or installation.
9. Bespoke, Made-to-Order, and Special-Order Equipment
Some mortuary equipment, refrigeration systems, mortuary chambers, cold rooms, and specialist products may be bespoke, made-to-order, configured to customer requirements, or specially ordered from manufacturers. Once confirmed, these orders may not be cancellable or refundable except where required by law or where the product is faulty.
10. Cancellations and Returns
Cancellation and return rights depend on the type of customer, product, and order. Business-to-business orders, bespoke products, special-order items, installed equipment, used equipment, or items manufactured to specification may not be eligible for cancellation or return unless faulty or otherwise required by law.
If you wish to cancel or return an item, please contact us as soon as possible. Returned items must be unused, in original condition, and in original packaging unless otherwise agreed. Return carriage, restocking, inspection, and handling charges may apply where permitted.
11. Faulty or Damaged Goods
Please inspect all goods upon delivery and notify us promptly of any damage, shortage, incorrect item, or fault. Photographic evidence may be required to help us assess the issue and resolve it efficiently.
Where goods are confirmed to be faulty, damaged, or incorrectly supplied, we will provide an appropriate remedy in accordance with applicable law and the manufacturer’s warranty terms where relevant.
12. Warranties
Warranty cover may vary depending on the product, manufacturer, installation, usage, service history, and warranty terms supplied with the equipment. Warranty does not usually cover misuse, accidental damage, unauthorised repairs, incorrect installation by third parties, poor maintenance, consumable parts, wear and tear, or failure to follow operating instructions.
Regular servicing and maintenance may be required to preserve equipment performance, reliability, safety, and warranty validity, particularly for mortuary refrigeration systems and specialist equipment.
13. Servicing and Maintenance
Where we provide servicing, maintenance, repair, or emergency support, the scope of work, response times, parts availability, labour charges, and call-out fees will be confirmed separately. Availability may vary depending on location, engineer schedules, parts supply, site access, and the condition of the equipment.
14. Customer Responsibilities
- Provide accurate order, delivery, installation, and site access information.
- Ensure the product ordered is suitable for the intended use and environment.
- Check product dimensions, technical requirements, and site conditions before ordering.
- Use products safely and in accordance with manufacturer instructions.
- Arrange appropriate maintenance, servicing, and inspections where required.
- Notify us promptly of any delivery issue, defect, fault, or service concern.
15. Limitation of Liability
Nothing in these Terms & Conditions limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any rights that cannot legally be excluded.
Subject to the above, GM Mortuary / Gmcold Refrigeration Ltd shall not be liable for indirect loss, loss of profit, loss of business, loss of revenue, loss of goodwill, business interruption, or consequential loss arising from the use, delay, delivery, installation, servicing, or supply of goods or services.
16. Force Majeure
We shall not be responsible for delays or failure to perform our obligations where caused by events outside our reasonable control. This may include manufacturer delays, supply chain disruption, transport issues, severe weather, labour shortages, strikes, accidents, breakdowns, public health events, import delays, changes in law, or other circumstances beyond our control.
17. Intellectual Property
All website content, including text, images, graphics, logos, design, product descriptions, and layout, belongs to GM Mortuary, Gmcold Refrigeration Ltd, our suppliers, or licensors unless otherwise stated. You may not copy, reproduce, distribute, or use website content for commercial purposes without written permission.
